Terms & Conditions
Between:
(1) “Flat Fee Limited” or “we” or “us” and,
(2) The individual, partnership, company or other person ("Client" or "you" or "your") to whom Flat Fee Limited agrees to provide the Services detailed within the site.
1. The Site
1.1 Subject to this agreement, we will provide a secure personal account through which you will have access to input, view and update your personal data held thereon.
1.2 You acknowledge and agree that Flat Fee Limited control access to the Site
1.3 Flat Fee Limited reserves the right to cancel or withdraw the On-line Hosting, Account access or other parts of the Services, and retain any fee paid, if it becomes aware that:-
a. you have not paid any outstanding fee payable to Flat Fee Limited;
b. you have failed to comply in all material respects with these terms and conditions;
1.4 Whilst we cannot guarantee uninterrupted or timely availability, we aim to operate the Site continuously, i.e. 24 hour access. Unfortunately, we cannot fully control downtime due to maintenance and upgrades nor can we predict or control delay due to network traffic.
1.5 As part of our ongoing commitment to providing a top quality website service we reserve the right to change the functionality and layout of the Site without notice.
2. Personal data & property details
2.1 You confirm that you own any property details, including photographs, you supply. You agree to grant Copyright licence to Flat Fee Limited. You should not use photographs taken by an Estate Agent, or similar, without their prior approval.
2.2 You are responsible for the accuracy of the property details, including photographs, held within your Account. It is imperative that you ensure that your data is complete, fair and accurate. Misleading details and photographs, in error or otherwise, will be to the detriment of selling or letting your property.
2.3 You agree to indemnify Flat Fee Limited against any claims or expenses arising from misleading information entered into your Account.
2.4 Flat Fee Limited reserve the right to cancel your Account without refund if:
a. You populate your Account (our site) with material of an unlawful, objectionable or obscene nature;
b. You falsify details with the intent to mislead or defraud;
c. You include other site URL's within your Account (our Site) without our written authority. It is advisable to not include personal or confidential information which you do not wish the public to see unless this is contact information.
2.5 The asking price or rent you set for your property listing is your sole responsibility. Flat Fee Limited suggests that you refer to our selling and letting advice and guides sections for assistance in this area.
3. Our Service
3.1 In order to restrict our ongoing liabilities we are required to apply a contract period of 3 months to your Account.
3.2 Flat Fee Limited does not arrange or attend property viewings, nor will we advise on or assist in the price negotiation process.
3.3 Entry into this contract will not prevent you selling or advertising your property through an estate agency or other sales medium.
3.4 The full extent of our listing options and prices for letting and selling are available for viewing.
4. Payment Terms
4.1 Payment must be received in full, via our online payment system or via another method as agreed with Flat Fee Limited, prior to the provision of your selected Service. All fees are exclusive of GST.
5. Security
5.1 The purpose of the Site is to expose properties for sale or let to the wide and growing internet audience. Whilst we will use all reasonable means to protect Site security, we do not warrant this. We would ask that you contact us immediately if you become aware of any outside interference with your Account. You should ensure that you keep your login details securely protected.
5.2 All prospective buyers or renters must register with our Site before they are able to initiate contact with our advertisers. Please refer to our Privacy and Security policy for more information.
6. Privacy
6.1 The information you commit to your Account may be visible to the internet public. Whilst we do not pass information to other parties or organisations, we may utilise other property advertisers and search engines to maximise your potential exposure. Please refer to our Privacy and Security policy for more information.
7. Refunds
7.1 No refunds of fees will be made once your property listing is submitted and live on our Site, unless we are advised by email within 24 hours. This does not affect your statutory rights as a consumer.
8. Complaints

9. Legal & Conveyancing
9.1 The Site does not intend to constitute any form of legal contract or agreement between vendor and purchaser, nor does it form any part thereof. You should seek legal advice and services in this regard.
10. Pricing
10.1 We reserve the right to amend our pricing structure without notice.
11. Commercial Clients
11.1 Our price structure is intended for homeowners selling or letting at low volume. We are pleased to discuss discounted rates for developers or companies marketing numerous properties. Please contact us to discuss.
12. Trademarks
12.1 You agree that Flat Fee Limited retain all title / interest in relation to the Site including all trademarks.
12.2 No logo's, images, text or other Site material must be copied or reproduced without the express permission of Flat Fee Limited.
13. Guarantees
13.1 We would remind you that planning regulations do not allow more than one board per property.
14. Definitions
In this account;
“Account” means your personal, password secured area (containing your data) within the Flatfee website.
"Data" means all information in any form submitted by you to the Flatfee Site in relation to this agreement;
"On-Line Hosting" means that part of the Services comprising of on-line hosting of the property details on the Site;
"Property" means your property or estate in land, in respect of which we agree to provide the Services;
"Property Details" means those parts of the Data that are put on the Site for public access;
"Services" means the services for selling or letting your property that Flat Fee limited agrees to provide under this agreement;
"Site" means Flat Fee Limited’s on-line advertising portal for homes, presently located on the Internet at uniform resource locator (URL) "http://www.flatfee.je".
